The Administrative Contingent suspends a consultation on the construction of a marina
The Administrative Court No. 2 of Girona has cautiously suspended the popular consultation scheduled for November 20, regarding the construction of a marina with 400 moorings in the town of Gerundense of Tossa de Mar.
The judge has taken this decision at the request of the Government Delegate in Catalonia, María de los Llanos de Luna, who has filed an appeal against the full agreement and the municipal decree authorizing the consultation. In the appeal, the State submits that the call for such a consultation is of a general nature and that it is based on one of the precepts of the Law on Consultations that the Constitutional Court has laid down. According to the appeal, the city council would have had to ask for authorization in the State to ask the citizens whether or not they want to change the urban planning to make a port, a hotel and four luxury villas.
The consultation was scheduled for next Sunday and had been approved by the municipal plenary on 22 September. The City Council has announced that it will make allegations against the state challenge that prevents the popular consultation.
