CEACNA is discussing a European judgment on a nautical concession extension

The CEACNA Board of Directors has addressed a recent judgment of the European Court which has admitted an action by an Italian company against the automatic extension of a concession to a competitor in a lake (Canary Ports)

The Spanish Confederation of Nautical Clubs (CEACNA) considers that the system of extensions to concessions in seaports in our country is perfectly supported by the Law on Costas and the Law on State Ports and has at no time been called into question by the European Union. The Board of Directors of CEACNA, one of the main interlocutors of the Spanish recreational nautical, met at the Nautical Club of Sa Rípita (Mallorca) and, among other issues, addressed a recent judgment of the European Court which has admitted an appeal from an Italian company against the automatic extension of a concession to a competitor in a lake.

CEACNA states that, after a first analysis, this judgment would not affect the demanial concessions of seaports in Spain because the judgment refers to a concession to a service company on a lake and that the dissemination of information that seeks to raise doubts about the legality of the extensions can only respond to some kind of interest of companies seeking to opt for such concessions. CEACNA wishes to point out that in the Spanish legal system there are no automatic extensions to demanial concessions in seaports and that the dealers who have obtained an extension or aim to achieve it must follow a procedure which, among other requirements, includes updates of royalties and significant economic investments in infrastructure in the port facility.

The Board of Directors of the Spanish Confederation of Nautical Clubs, an association representing a collective of about 200,000 people from 160 clubs, took advantage of meeting with the president of the Royal Spanish Federation of Vela, Julia Casanueva. The nautical clubs are pleased with the new course that the Federation has taken since Casanueva's arrival in the presidency, which has been characterized by greater transparency and budgetary control. The meeting of CEACNA was also attended by the Secretary General of the Spanish Association of Nautical Companies, Carlos Sanlorenzo. After the meeting, the need to deepen the collaboration between these two entities on issues relating to recreational and sports nautical. It should be recalled that ANEN and CEACNA signed a partnership agreement earlier this year that established a framework for support between the two associations and that it established regular meetings with the aim of analysing the needs of their partners and developing concrete actions.
