Javier Hernanz risks disqualification for a very serious offence under the Sports Act

The president of the Royal Spanish Federation of Piragüismo, the Asturian Javier Hernanz, begins the electoral process in breach of the Rules and the Electoral Calendar approved by the Commission Delegate of the RFEP and subsequently by the Commission of the Higher Council of Sports. The Federation has not yet published the initial census, has not appointed the Management Commission or the Electoral Board, established in the Electoral Calendar for 1 September. The President has also not called on the Board of Directors or the Delegated Committee, which are responsible for appointing the Management Commission and the Electoral Board respectively.

Javier Hernanz is also violating article 6.4 of Order EFD / 42 / 2024, which regulates electoral processes in Spanish sports federations. With the electoral call for 2 October, the legal deadline for the publication of the initial census, which should have been made public by 12 September, has already been breached.

Javier Hernanz's negligence, deliberately blocking the publication of the initial census, deprives the federations of their fundamental right to file complaints and correct the errors in the census. Moreover, its flagrant non-compliance with the deadlines set out in the calendar approved by the CSD not only demonstrates a total lack of responsibility, but also seriously compromises the validity of the entire electoral process, exposing it to challenges and endangering the legitimacy of electoral acts. Javier Hernanz's clearly obstructive attitude has not only de facto paralyzed the electoral process, but goes far beyond mere neglect. His inaction reveals a deliberate intention to hold on to power, avoiding at all costs to submit to the will of the federations in the ballot box. Javier Hernanz, with his inaction to comply with the Electoral Regulations, risks a disqualification for a very serious offence under the Sports Act.

2024-09-13: Fredi Bea wins RFEP and CSD... and presents new complaints

The central court of the administrative dispute number 4 in Madrid has given a severe varapalo to the Spanish Federation of Piragüismo (RFEP) and to the Higher Council of Sports, in estimating the demand of Alfredo Bea, president of the Galician Federation of Piragüismo, in which it was denounced up to four fundamental rights in the articulation of the federal electoral bases that violated the rights of equality, honour, personal and family privacy, as well as the participation in public affairs, all because in the bases there is an article that specified that the candidates should lack of criminal protection, as a criminal offence that was incapacitated by Alfredo Bea civil service to be a criminal offence, which was incapacitated for seven years.

The CSD is the body that protects sports federations, so it should have ensured that they did not engage in any kind of irregularity, so in giving a green light it approved "the extralimitation in which the regulation incurs, exercising both administrations powers which, by constitutional mandate, can only be exercised by judges."

"If a citizen is sentenced to a special sentence of disqualification and, once the sentence has been served, he is prevented from applying for a charge for having a criminal record, in practice the sentence is being extended beyond what was agreed," explains the sentence, before pointing out that the excitation "is also material, as it is intended to extend a disqualification to be a councilor or mayor to another elective office not included in the judgement" which he condemned in his day Alfredo Bea.
