British nautical degrees will be valid in Spain before the summer begins
The result of the discussions held by ANEN with the General Directorate of the Merchant Navy, always meets the needs of our sector, and in relation to the effects of the Brexit on the validity in Spain of the nautical titles of British citizens, these British titles will be recognized in Spain before the beginning of the summer season.
In the paper published on the day by the DGMM and discussed in the Webinar organized by ANEN on legislative updates under way last February, it was stated that "Since 1 January 2021, British citizens cannot continue to benefit from the recognition of their recreational titles to govern Spanish-flag recreational vessels, in the absence of compliance with the requirements of the additional third and fourth provisions of Royal Decree 875 / 2014, when the United Kingdom is considered a third country and not to be included in the list of countries listed in Annex IX, whose titles are recognized."
This situation, also in accordance with the information provided by the DGMM, will change once the Royal Decree regulating the equipment for the safety and prevention of the pollution of recreational vessels, which has included a provision amending the aspects contained in Royal Decree 238 / 2019, including an amendment to Royal Decree 875 / 2014 (10 October, which regulates the nautical degrees for the government of recreational vessels), has been published to include Britain in its Annex IX (Titles issued by other states). Therefore, with the entry into force of the new Royal Decree, which is expected to be published in the near future, all the above-mentioned will no longer be valid and British citizens will be able to use the RYA title to rent and rule Spanish flag recreational vessels in our waters.
