The General Directorate of the Merchant Navy responds to the consultation that Anavre put forward years ago... and that, at last, they have resolved.

This is the use of list 6 ships by shipowners or related persons resident in Spain, and the answer takes up most of our approaches:

1) Boats covered by the IEDMT exemption: Shipowners can carry out transfer tasks, delivery to customers, transfer to port, etc... always, and make private use of the ship after four years of full dedication to the charter activity from the beginning of the ship.

2) Boats with paid IEDMT: the shipowner can use them whenever he wants.

CONSULTA: The possibility of private use, on a sporadic basis, of vessels or vessels dedicated to leasing or nautical charter in Spanish territorial waters by their owners or managing partners resident in Spain or holders of establishments located in Spain.

DGMM REPLY: By the water lease contract the lessor gives or makes available to the lessee, in exchange for price, a ship or vessel for a period of time and for an exclusively sporting or recreational purpose (art. 307 of the Maritime Navigation Act). The nautical lease therefore has two modalities: the lessor may hand over the vessel or vessel subject to the contract to the lessee, who will have the title required for his government, or simply make it available for enjoyment with the appropriate professional crew.
