On the first date of June, the Order SND / 487 / 2020 has been published in the BOE, which contains the regulations that will be in force during phases II and III of the deceleration and that gives continuity to the response that the General Directorate of the Merchant Navy made to the approach of ANEN to include the practice of recreational or sports navigation, gradually, from phase 0 of the Government's Plan for the Transition to a New Normality.

According to the new Order SND / 487 / 2020, the following new developments are introduced with respect to the previous one, published on 9 May:

FASE II or intermediate, applies to the territories of the province or territorial reference unit that have exceeded phase I, as well as in the territorial area of each of the islands of the Autonomous Communities of Illes Balears - with the exception of the territories on which the progression to phase III is agreed or advanced - and the Canary Islands:

  • Navigation and other nautical recreational activities of a private nature: all persons in the same province, island or autonomous city in which the vessel is tied are allowed to enjoy recreational navigation. All nautical recreational activities are included, with no limitations other than those governing in general, such as those of a territorial nature and the adoption of preventive health measures.

The occupation on board is extended to 75% of the persons authorized on the certificates of the vessel, unless they are persons living in the same home in which case the 100% occupation may be reached. In any case, the number of persons on board the vessel may not exceed 10.

In the case of nautical motorcycles, only one person on board may occupy it, except for persons residing at the same home, in which case they may not exceed the number of places authorised by the manufacturer of the same.

  • Nautical charter: persons in the same province, island or autonomous city in which the rental companies are located may rent, including in nautical lease, recreational boats, nautical motorcycles and recreational nautical devices. The same limitations shall apply to the maximum number of persons on board vessels and nautical motorcycles governing private navigation at this stage.
  • Navigation practices for the obtaining of recreational titles requiring the use of vessels: all persons on board must be in the same province, island or autonomous city in which the vessel is tied. The occupation may not exceed 75% of the persons authorized in the certificates of the vessel, without in any case being able to exceed the number of students specified in article 15.8 of Royal Decree 875 / 2014 of 10 October, which regulates the nautical degrees for the government of the recreational vessels.
  • In all the above cases, the navigation shall be limited to the adjacent waters of the territories of the province, island or territorial reference unit, provided that the limitations or restrictions contained in the respective certificates, documents or titles of the recreational vessels and vessels, the nautical motorcycles and the nautical recreational devices, as well as the persons entitled to govern them, are not exceeded.

The new SND / 487 / 2020 also refers, in its Article 4, to the transport of passengers, and determines that in the territories that move to phase II, vessels and vessels engaged in the transport of passengers, other than cruise passenger ships, may sail and fair in the adjacent waters of those territories. In the Autonomous Community of Illes Balears, the occupation for this type of vessel may not exceed 50% of the maximum number of passengers on its certificates.

FASE III: Water recreational activities are already authorised, with no limitations other than those governing in general, such as those of a geographical nature and the adoption of preventive health measures.
