BOE publishes the update of pandemic-motivated measures

Today, Order TMA / 419 / 2020 of 18 May, which updates the measures adopted in the area of general management of maritime navigation during the state of alarm for the management of the health crisis caused by the Covid-19, has been published in the Official Gazette of the State and in implementation of the Plan for the Deceleration of the Extraordinary Measures to Combat the pandemic, adopted by the Council of Ministers Agreement of 28 April 2020.

In particular, and as far as the field of recreational nautical is concerned, Article 3 (2) sets out the restrictions in force:

Update of existing restrictions on recreational nautical

Foreign vessels or recreational vessels which did not have their port of stay in Spain shall not be allowed to enter any Spanish port. Except for this restriction vessels and vessels with only professional crew on board. Article 4 of the Order states:

1. The transfer of vessels, vessels or recreational devices to shipyards, boarders, repair workshops or the like for maintenance or repair, or for sale, between the various provinces, islands or territorial reference units referred to in Article 3 of Royal Decree 514 / 2020 of 8 May, shall be as follows:
(a) The transfer of the vessels shall be carried out by the personnel seconded to the undertaking or by the crew authorised and hired by that undertaking and without passengers on board.
(b) Before the transfer is carried out, a responsible statement shall be submitted through the electronic headquarters of the Ministry of Transport, Mobility and Urban Agenda, informing the relevant maritime master of the transfer to be made, without the need to expect an authorisation from the Administration to proceed with it. The declaration must be submitted by the master seconded or hired by the company.
(c) At all times, the protocols and procedures which may have been issued by the autonomous communities in whose ports it is intended to access shall be observed.
(d) The rules in force on the release and registration of vessels, including, where appropriate, a temporary navigation permit for those who are not registered, shall be complied with.

2. In the territory of the province, island or territorial reference unit where, under the Demarcation Plan, they are kept in phase 0 or in preparation for the deceleration, the transfer of ships, vessels or recreational devices to shipyards, boarders, repair workshops or the like for maintenance or repair work, it may be carried out by its owner, provided that the transfer occurs within the municipal term where it resides. Before the transfer, regardless of whether the ship, the vessel or the artefact belongs to list 6 or 7, or if it is registered under the special regime, or if they are foreigners having their port of stay in Spain, the owner shall submit, through the electronic headquarters of the Ministry of Transport, Mobility and Urban Agenda, a responsible statement informing the relevant maritime master of the transfer to be made, without the need to expect an authorization from the Administration to proceed with it.
