After two years of intense joint work between the employer ANEN and the DGMM has been achieved the objective

As the Director General of the Merchant Navy, Benito Núñez Quintanilla, advanced during the past VII Nautical Congress, and after two years of intense activity and joint work by ANEN with the DGMM, the Council of Ministers has approved one of the most expected standards by the nautical sector.

The Royal Decree on the provision of similar qualifications for the management of recreational boats will be published in the BOE and the safety measures for the use of nautical motorcycles will be updated and will enter into force on 1 July.

The main objective of the new standard is to respond to the long-expressed demand by the nautical recreational graduates "in the sense that their area of activity may be extended to the exercise of certain paid services which are in accordance with their own recreational qualifications."

NEW ATRIBUTIONS RELATED TO THE REAL

  1. Attributions to provide certain services paid for by Recreation, Yacht and Yacht Captains:
  2. The transport of supplies made by recreational vessels and nautical motorcycles for other recreational vessels or vessels made by recreational vessels for other recreational vessels or vessels.
  3. To carry out activities for the docking, founding or movement of recreational vessels within the waters corresponding to ports, seaports or seaports.
  4. Conduct sea tests on board recreational boats and nautical bikes.
  5. Government of boats for relief on beaches.

  7. In addition to all the above-mentioned powers, both the Yate Patron and the Yate Captain will be able to make tourist excursions and the practice of recreational fishing.

In order to qualify for the above-mentioned qualifications, the nautical graduates shall only carry out the basic safety training course for seafarers of the DGMM, in addition to having those additional powers specific to each degree of recreational nautical.

Once the course has been completed, the nautical graduates shall be entitled to carry out the service delivery activities indicated with the following limitations:

The above-mentioned nautical graduates, after having obtained the qualification by carrying out the course and paying the corresponding fee, shall have a limitation of up to five miles - from the port, marina or marina from which the loan is made - to carry out the above activities.

A larger number of passengers or cargo volume for which the vessels were designed may not be moved, but in no case may the number of passengers exceed 6 persons.

Amendment of RD 259 / 2002 of 8 March, updating the safety measures in the use of water bikes.

The aim is to update and homogenize the requirements for the development of activities related to the commercial exploitation of water motorcycles, both in terms of the rental by hours or fraction in circuits, with monitor excursions or the particular rental of water motorcycles. The new wording is intended to resolve the many questions of interpretation which so far existed by the Administration and the operators of this nautical activity.

Similarly, the government of water bikes will be allowed through the navigation licence, and other demands requested by the companies engaged in the exploitation of water motorcycles are met.

The approved RD also makes some amendments with regard to Royal Decree 875 / 2014 of 10 October, which regulates the nautical degrees for the government of recreational boats with the aim of:

  • Strengthen training for the achievement of recreational qualifications.
  • To reduce some burdens on the owners of recreational titles.
  • And to clarify certain precepts that occur in some errata or practice has shown that they need some concrete.

For the nautical sector, represented by the ANEN employer, the adoption of this Royal Decree is an important step in the updating of its legislation which will have an impact on improving the competitiveness of its professionals.
