As ANEN announced during its participation in the last edition of the Barcelona Nautical Salon, the future regulations that will enable the nautical graduates to perform certain paid services, in accordance with the degree of recreation they possess, takes momentum and is already in the process of hearing.
The future Royal Decree, as detailed in the text of the Project, has the main objective of responding to the demand expressed by the long-term nautical recreational graduates "in the sense that their area of activity may be extended to the exercise of service-providing actions which are in accordance with their own recreational qualifications," in addition to ... "constitute an instrument for promoting the practice of recreational navigation, provided that this is done subject to the provisions of maritime legislation and Law 17 / 2009 of 23 November 2009 on free access to and exercise of service activities."Royal Decree 259 / 2002 of 11 March 2002 updating the safety measures for the use of nautical motorcycles will also be amended.
The Directorate-General of the Merchant Navy will immediately publish the RD Project on its website, which after the hearing will be passed to the Council of Ministers and will continue its legislative process until its entry into force. ANEN has worked closely with the General Directorate of the Merchant Navy in the development of the future standard, with the aim of supplementing Royal Decree 875 / 2014 of 11 October, which regulates nautical degrees.
This is a summary of the main powers provided for in the future RD... the powers to provide certain services paid by the Recreation, Yacht and Yate Captains, may provide the following services:
- The transport of persons and goods by recreational vessels to other recreational vessels or vessels.
- The conduct of tourist excursions and the practice of recreational fishing.
- To carry out activities for the docking, founding or movement of recreational vessels within the waters corresponding to ports, seaports or seaports.
- Conduct sea tests on board recreational boats and nautical bikes.
- Government of boats for relief on beaches.
- Provide crew services on ships.
The basic safety training course for seafarers of the DGMM shall be carried out by the nautical graduates only in order to qualify for the above qualifications.
Once the course has been completed, the nautical graduates shall be entitled to carry out the service delivery activities indicated with the following limitations:
- The above-mentioned nautical graduates, after having obtained the qualification by carrying out the course and paying the corresponding fee, shall have a limitation of up to five miles - from the port, marina or marina from which the loan is made - to carry out the above activities.
- A larger number of passengers or cargo volume for which the vessels were designed may not be moved, but in no case may the number of passengers exceed 6 persons.
The future standard will also amend RD 259 / 2002 of 8 March, updating the safety measures in the use of water bikes.
The aim is to update and homogenize the requirements for the development of activities related to the commercial exploitation of water motorcycles, both in terms of the rental by hours or fraction in circuits, with monitor excursions or the particular rental of water motorcycles. The new wording is intended to resolve the many questions of interpretation which so far existed by the Administration and the operators of this nautical activity. Similarly, water motorcycles will be allowed to be managed through the navigation licence.
