The law will apply for the collection of the fees and has not been applied to renew the concessions... the inaction of the Consell Valenciano in the last two years leads again to temporary authorizations that endanger the nautical sport... will ask the Consell a definitive solution for its future... the nautical see a complete blow

The Association of Nautical Clubs of the Valencian Community has been surprised by the information known today by the Consell today in which it is stated that "the activity and continuity of the nautical clubs is guaranteed."From the ACNCV it is considered that issuing a new temporary authorization is a patch, which prevents the possibility of making investments in the clubs to improve the facilities and that it continues to leave its future in the air, and at the same time will cause a significant reduction in sports activity.

This is due to the fact that a new annual temporary authorisation, due to the inaction of the Consell in the last two years to process the concessions, involves the entry into force of new charges that the Association states are to be settled with a different method of calculation than that approved by the Ports Act of 2014. This will cause in some cases a 7-fold increase in the amount to be paid to the administration for fees. The ACNCV considers that the procedure for the renewal of concessions should have been opened for the application of this rate in such a way that, with legal certainty and investment plans, the renewal of the nautical clubs could be undertaken and the activity and the basic nautical sport should continue to be encouraged, and should not be applied while having provisional authorisations of one year and with the method of calculation prior to the adoption of the Act.

The assessments referred to by the Conselleria were made in February 2014 before the entry into force of the Act. During the process of the Act, the Association and the Generalitat agreed on an assessment method that took into account the sports nature of the facilities and is not the one used for the calculation of the new fees. The information transferred from the Conselleria points to the expected increase in fees with the assessments made before the entry into force of the Law on Ports. The ACNCV is not against the method approved in the Law for the calculation of the fee, but considers that the Generalitat has had three years to review and update the assessments with the method approved in the Act. Once again, the inactivity of the Territory & apos; s Housing, Public Works and Vertebration Council jeopardizes the activity carried out by the Nautical Clubs that will be put into liquidation if this rate is not calculated to form rigorously with the method approved in the Law on Ports.

"The method used for the calculation of the rates in the assessments carried out in February 2014 will lead to a cessation of the sports activity, an increase in the rates and in some nautical clubs may mean its disappearance, which is not understandable, it is that for some things the law does apply and for the calculation of the rate it does apply, but incorrectly", said José Mas, president of ACNCV.

There are currently 11 administrative concessions that expire this month are those belonging to the CN Vinaroz, CN El Perelló, CN Culera, CN Jávea, CN Moraira (Teulada), Puerto Deportivo Les Basetes (Benissa), CN Altea, CN Costa Blanca (Alicante), CN Torrevieja, Puerto Deportivo Dehesa de Campoamor and Puerto Deportivo Torre de la Horadada, to which is joined by the CN OIiva that will also expire this year. From the ACNCV you want to remember that "the nautical clubs are non-profit-making entities that provide management and benefits, from the exploitation of the moorings and premises, to the competition teams and to the promotion of the basic nautical activity" and that with the application of the new incorrectly calculated rates, the promotion of nautical activity can be greatly reduced and even cause its disappearance.

The publication of tenders for the drafting of urban planning proposals only means that the procedures for the new concessions are to be further extended, since at least another two years will take for a final resolution. The invitation to tender for the drafting of proposals for urban planning in the ports of Vinaròs, Burriana, Culera, Denia, Jávea and Altea was published on 1 June. A process that aims to develop the reference conditions for all facilities. A number of proposals, which, in the opinion of the ACNCV, are exceeded in terms of integration with the municipalities and which could substantially affect the PGOU of the municipalities and which also leave out half of the nautical clubs that also have the concession expired and will take even longer to start the renewal procedure.
