New impetus to the charter in the Balearic Islands as a regulation of the sector comes into force
The legislation of the nautical sector is taking a further step in the improvement and simplification of the activity of the charter, with the publication on 6 May last, in the Official Bulletin of the Balearic Islands (BOIB), of the new Decree 21 / 2017 which regulates the activity of the charter in the Balearic Islands and which has been applicable since yesterday, 7 May. ANEN (National Association of Nautical Enterprises), together with AENIB (Association of Nautical Enterprises of Balearic Islands) and AEGY (Spanish Association of Great Yates), have actively contributed to the development of the text of the Decree. The new legislation will no doubt contribute to the growth of the activity of the rental of recreational boats in the Balearic Islands, which already occupies the first position of the nautical market of the charter at national level - with 26% of the share of this market -, among other factors for the simplification of the bureaucratic procedures it introduces. In this regard, the requirement of the prior administrative authorisation required in the previous legislation for the exercise of the activity is replaced by a simple responsible declaration by the submission of a series of documents to the General Directorate of Ports and Airports of the Generalitat.
To stress also that with the new Decree, for the first time, they may request the responsible declaration to carry out the charter activity in the Balearic Islands, both the Spanish vessels and vessels listed in the sixth list and those registered in the Special Register of the Canary Islands (or in any other special Spanish register that allows for the rental of vessels and recreational vessels) and in any maritime register of the European Union if it is commercial and non-private. Bringing down professional intrusism is another of the strengths that the sector hopes to achieve with the new regulation, by contemplating the creation of the Balear Register of boats and recreational vessels for rent, to which both operators and end users can access to see if the company offering its charter services is regularized to carry out this activity in the Balearic Islands. The new Decree applies to all recreational vessels which have as their purpose the activity of the charter in the ports or points of the Balearic Islands, except for vessels of a length of not more than 2.5 metres, auxiliary vessels which have been rented with the main vessel and nautical motorcycles and floating devices, since they already have their own regulation on the charter.
Since yesterday, 7 May, the new Decree regulating the activity of the rental of recreational boats in the Balearic Islands has been in force and is an important step forward in the simplification of the bureaucratic procedures for the exercise of the charter. The new regulation will help to stop professional intrusism in the activities of the charter as it includes the creation of a public register of companies and vessels dedicated to the rental in Baleares. The new Decree applies to all recreational vessels intended for the activity of the charter in the Balearic Islands, except for vessels of a length of not more than 2.5 metres, auxiliary vessels that have been rented with the main vessel and nautical motorcycles and floating devices, which already have their own regulation on the charter.
