La Galician de Vela asks for rectification of ND's news about the case "Juan C. Pérez Olmedo"

The Galician Federation of Vela has sent us a letter in accordance with the provisions of Organic Law 2 / 1984 on the right of rectification, expressing its partial disconformity with the article published by NAUTICA DIGITAL on April 4 under the title "VARAPALO OF THE JUDGATE OF SANTIAGO TO THE GALLEGE OF VELA." In the opinion of Manuel Villaverde as president of the said entity, this news contains errors and inaccuracies that must be corrected for the sake of the veracity of the information... and for this reason we have been asked to publish the text referred to; what we do with great pleasure in order to safeguard your democratic right of rectification. DIGITAL NAUTICA over the next few days will give your opinion on this rectification... for the moment we offer you the version of the facts by the Galician Vela Federation in compliance with the legislation in force.
Rectification to the news "Varapalo del Juzgado de lo Colectado de Santiago a la Gallega de Vela" published in nauticadigital on April 4
1. The first paragraph of the news contains a citation preceded by the phrase "the sentence reads the following." The following text, however, does not correspond to the judgment that is being spoken of, but is in part an opinion.
2. It is said that "The Ozoaqua was disqualified in several races and was not even allowed to participate with very pilgrims and arguable arguments." The reality is that the ship was never prevented from taking the exit and in two races was disqualified for violating article 20 of the ISAF Regulation which prohibits certain allusions in the advertising of the vessels.
3. It is not true that Mr. Pérez Olmedo was prevented from exercising fundamental rights. He filed a claim for fundamental rights injury and was dismissed at first instance by the Court of the Administrative Disputes of Pontevedra and on appeal by the High Court of Justice of Galicia.
4. It is equally false that the President of the Federation and Don Fernando Giraldo "became a judge and executioner." The disciplinary decisions were taken by the competent bodies, to which neither of the two referred to belong.
5. The news states that "the judgment of the Court has been very clear when it comes to the alleged irregularities by ordering the annulment of the decision." This claim is not true since the judgment states that the CGXD in its resolution did not respond to all the allegations made by the appellant and therefore orders him to reissue it, without the court ruling on the meaning of that resolution and without stating that the irregularities reported are true. In fact, the sentence does not annul the penalty as requested by the appellant.
6. It is also a false attribution to say that the sentence "is stating to the clear that the Galician de Vela - it has tricked - or fencing non-real data or even generating the figure of a single judge of its unregularly appointed string." At no point does the judgment say such a thing, but it is a question of a side statement.
7. The sentence does not result in any kind of responsibility because the court, which could do so, did not annul the penalty imposed on Mr. Pérez Olmedo. The penalty is still in force and no one has said it is null and void. What the judgment has agreed is that the CGXD must reissue the resolution by answering all the questions raised. Less can be said about criminal proceedings.
